California Implements Gender Neutral Law: AB-1084 Takes Effect on January 1st, 2024
AB 1084, which was signed into law by Governor Newsom in October of 2021, is set to take effect on January 1st, 2024. According to the Legal Research Center at the University of San Diego Law School, this law will impact department stores in California that have more than 500 employees across all their locations and sell children’s items and toys. These establishments will be required to have a “gender-neutral” department in addition to their existing “boys” and “girls” departments.
Children’s items and toys are defined by the law.
“Childcare item” means any product designed or intended by the manufacturer to facilitate sleep, relaxation, or the feeding of children, or to help children with sucking or teething.
Toy” means a product designed or intended by the manufacturer to be used by children when they play.
A child is someone who is 12 years of age or younger.
