California law banning legal gun carry to take effect after victory in appeals court
In a recent development, the ninth US circuit court of appeals has approved the enforcement of California’s law that limits the possession of firearms in most public places. This law will take effect on January 1, 2024. The court’s decision comes after suspending an injunction from December 20, which had declared the law unconstitutional.
In September 2023, California Governor Gavin Newsom signed a law that was scheduled to go into effect on January 1, 2024. However, in December, a judge’s ruling raised constitutional concerns, leading to legal battles over the right to bear arms as protected by the second amendment.
Governor Newsom responded to the ninth circuit’s decision, expressing his support for California’s gun laws. He stated, “We are pleased that this ruling will enable us to maintain our common-sense gun laws while we appeal the district court’s concerning decision. The safety of places like hospitals, libraries, and children’s playgrounds is of utmost importance to Californians, and we will continue our efforts to keep them gun-free and secure.”
The three-judge panel has issued an administrative stay, which temporarily lifts the injunction. This stay will remain in effect until another panel within the ninth circuit can deliberate on a more extended pause. The purpose of this pause is to provide additional time for legal proceedings.
